It boils down to money. Con Exclusives have better profit margin compared to time/effort/cost to make them and many people who do collect figurines buy them as impulse buys during cons. Such figurines are pride and joy for showing off later to other figurine collectors. Whether they are actually useful according to game rules is not of importance to many impulse buyers. It is the same phenomena in other figurine fields as well. You regularly have more rare German tanks in your bookshelf that German army actually fielded in any single combat or even have few units worth of night vision equipped German infantry. Naturally I do not admit that I am collecting such figurines compulsively.
And ALL the XTROs have that disclaimer, IIRC.

Regarding Wishes... I hope things look up for them. I ain't about to lose any sleep over the place, but the statement 'shares no corporate ties with CGL, just some common owners' does not ease my mind one bit. The sticky bit isn't with 'corporate' or 'owners', it lies in the word 'common'.
